These Terms and Conditions (“Agreement”) govern the use of services provided by Rise Visual Media (“we,” “us,” or “our”). By engaging with our services, you agree to the terms outlined below.
License and Ownership
- Rise Visual Media grants a non-transferable, non-exclusive license to use the media produced for the specific purpose agreed upon and paid for by the client.
- We retain ownership of all media unless otherwise agreed in a separate document.
- For MLS listings, the license is valid for the duration of the sale. If the property is relisted or sold again, an additional licensing fee will apply.
- Media produced is not for resale, gifting, or sharing with third parties who were not involved in the original project.
Travel Fees
- Some projects may be subject to additional travel fees, depending on the project location.
Quality Guarantee
- We guarantee the quality of our work. However, if an aspect of the project is not specified in advance and is felt to have been missed, we do not guarantee the completion of unspecified aspects without clear direction.
Media Credit and Use
- Media used for print must credit Rise Visual Media unless explicitly waived in a separate agreement.
- For websites, media is intended solely for use on the client’s specific website. Use on third-party sites requires express consent from Rise Visual Media.
- We request to be tagged on social media posts when possible.
Payment and Delivery
- Media will be delivered after full payment (100%) unless otherwise agreed in a separate document.
Limitation of Liability
- Rise Visual Media is not liable for any indirect, incidental, or consequential damages arising from the use of the media, including but not limited to loss of profit or business interruption.
- We are not responsible for any third-party use of the media beyond the agreed purpose.
Termination of Services
- Either party may terminate the agreement at any time with written notice. In the event of termination, any fees for services rendered up until that point are non-refundable.
- If the client terminates the agreement before the completion of services, they will still be liable for the agreed fees.
Indemnification
- The client agrees to indemnify and hold harmless Rise Visual Media from any claims, damages, liabilities, or expenses arising from the client’s use of the media, including claims from third parties.
Dispute Resolution
- Any disputes arising from these terms will first be attempted to be resolved through mediation. If mediation is unsuccessful, the dispute will be resolved in the jurisdiction of [your location] under the laws of [your state/country].
- Any legal action must be taken within one year from the date the issue arose.

SMS Terms and Conditions
SMS For Consent Communication The phone numbers obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.
Types of SMS Communications If you have consented to receive text messages from Rise Visual Media, you may receive text messages related to:
- Appointment reminders
- Meetings
- Follow-ups on cases
For example: “Hello, thank you for contacting Rise Visual Media. How can we help you? Reply STOP to opt-out at any time. Message and data rates may apply. For assistance, text HELP or visit our Privacy Policy and Terms of Service.”
Message Frequency Our SMS message frequency will range from 50 to 1,000 text messages daily across all users.
Potential Fees for SMS Messaging Many carriers charge a fee for each message sent or received. This fee can vary depending on the carrier’s pricing structure and whether the message is sent domestically or internationally.
Opt-In Method Customers will opt in for SMS messaging from Rise Visual Media through intake forms on our website located at www.risevisualmedia.com. This agreement for SMS will not be shared with third parties for marketing purposes.
Opt-Out Customers will be able to opt out of SMS messaging from Rise Visual Media by replying STOP at any time to any received SMS message. Once opted out, they will receive no further SMS communication. Customers can opt back in at any time by replying START.
